Noisy neighbour’s turn to face the music

A NIGHTMARE neighbour has been warned she faces eviction – and even jail – if she continues to bring misery to a South Shields street.

Kimberley Brett has plagued her neighbours in Gainsborough Avenue, Whiteleas, with months of loud music, shouting, swearing and noisy parties at her flat.

But now, South Tyneside Council’s anti-social behaviour unit has secured a postponed possession order in the county court, which means that if there are any further problems in the next year, they can apply to evict the 24-year-old.

Brett, who admitted the noise nuisance, also agreed to quieten down, but could face jail if she fails. Police chiefs say the order represents Her “last chance”.

Brett was served with a noise abatement notice by environmental health officers in December, but continued to disrupt her neighbours by playing loud music, shouting and swearing.

David Brooks, the council’s lead officer for crime and disorder, said: “Brett has received a number of written warnings about her behaviour, and that of visitors to her property.

“Despite these warnings, she has continued to cause noise nuisance to her neighbours.

“If her behaviour fails to improve, we will not hesitate to seek to evict her.

“We would ask local residents to report any further incidents of anti-social behaviour, should they arise.”

Neighbourhood Inspector Peter Sutton said: “This order is the last chance for Brett, and sends out a clear message that such behaviour will not be tolerated.

“Brett has shown a total lack of regard for other residents, and has received numerous previous warnings.

“I hope she can use this final chance as an opportunity to address her behaviour.”

Coun Jim Perry, lead member for neighbourhoods and environment, added: “Our residents are entitled to live without being unreasonably disturbed by their neighbours’ behaviour.

“In cases such as this, where the person causing excessive noise refuses to co-operate, we will take enforcement action.

“The service of an abatement notice and, where necessary, taking a case to the courts is a last resort, but sometimes there is no other option if we are to protect the health and wellbeing of our residents.”

The council’s environmental health team deals with about 1,000 complaints each year year about domestic noise. To report problems of noise, call 427 7000.
